HC: Total devpt operates at KP by October | Nagpur News


Nagpur: Expressing concern over delay in different developmental and beautification functions at Kasturchand Park, the Nagpur bench of Bombay high court on Tuesday led the respondents to complete the same by October.
While hearing a suo motu PIL (No. 45/2017) on encroachments and fail of this historical location, division bench of Justice Ravi Deshpande and Justice Amit Borkar requested the respondents to fill in each of the pits, level the floor and remove encroachment, if any. “This job is to be performed within two months from now and file compliance accounts,” the bench said before adjourning the hearing loss.
Before, amicus curiae Shreerang Bhandarkar pointed out into the courtroom that pits are dug up at the Kasturchand Park, which can be categorized as a heritage structure. In addition, he emphasized that encroachments have not been eliminated and the floor is in bad condition as it was not levelled until date.
Referring to the NMC’s affidavit of June 27, the seat pointed out that recreational centers such as beautification, compound walls, walls, parking bay, toilet blocks, electrification, floor levelling and flag mast region among others were supposed to be developed in the area.
Collector Ravindra Thakare had filed an affidavit telling that MahaMetro was granted permission for channel structure by broadening the security of 23 metres from LIC Square into RBI Square. A public bathroom has been assembled by NMC in south-west direction. For building walking, running, biking trails and plantation, collector stated he’d given consent to Solar Industries’s Shyam Mundada.
The HC had taken suo motu cognisance of a press accounts on encroachments for next time seeing non-compliance of its directives of April 27, 2017, to prevent any illegal action on the floor. “The press report introduces a disturbing and gloomy image of KP floor and old arrangement. It signals that the pavilion there is under illegal occupation of squatters and significant section of the earth is in a shambles. The HC can not stay silent spectator for this particular misuse,” the judges had cautioned.
